Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets out what you can and cannot do when using the Bury Digital Service. It forms part of our Terms of Service. Breach of this AUP is breach of those Terms and may result in suspension or termination of your account.

1. General principles

You must use the Service:

  • Lawfully and in compliance with all applicable Australian laws
  • For legitimate business communications with people who reasonably expect to be contacted by you
  • With respect for the privacy, safety, and rights of End Users

2. Messaging law compliance

The Spam Act 2003 (Cth) regulates commercial electronic messages in Australia. You must comply with it.

In particular, you may only use the Service to send SMS to End Users where you have a lawful basis to do so. For Bury Digital's missed-call recovery, this is typically because:

  • The End User called you first (giving rise to inferred consent for a single transactional response within a reasonable time)
  • The End User has provided express consent to be contacted by SMS

You must not use the Service to:

  • Send commercial messages to people who have not consented to receive them
  • Continue messaging an End User who has asked to stop
  • Disguise the sender or origin of a message
  • Send SMS to purchased lists, scraped contacts, or third-party databases

You are responsible for all messages sent through your account.

3. Prohibited uses

You must not use the Service to:

  • Harass, threaten, defame, or intimidate any person
  • Promote violence, hate speech, or discrimination based on race, ethnicity, religion, gender, sexuality, disability, or other protected characteristics
  • Send unlawful content, including content that infringes intellectual property, breaches confidentiality, or constitutes a misleading or deceptive trade practice under the Australian Consumer Law
  • Send content that is sexually explicit, gambling-related (without proper licensing and consent), or that promotes illegal substances
  • Impersonate another person or business
  • Phish, scam, or defraud End Users
  • Distribute malware, viruses, or other harmful code
  • Bypass authentication, rate limits, or security controls
  • Reverse engineer, scrape, or extract the Service or its data
  • Resell or sublicense the Service except through our Partner Program

4. Industries we do not serve

We do not provide the Service to businesses primarily engaged in:

  • Adult content or services
  • Multi-level marketing
  • High-pressure sales of unregulated financial products
  • Debt collection (without our prior written approval)
  • Any activity that is illegal in Australia

We may decline or terminate accounts in these categories at our discretion.

5. Volume and fair use

The Service is priced as a flat subscription with reasonable use. If your usage substantially exceeds typical patterns for a single business (for example, attempting to send tens of thousands of SMS per month through a single account), we may contact you to discuss appropriate pricing or limits.

6. Security and integrity

You must:

  • Keep your account credentials confidential
  • Notify us promptly of any unauthorised access
  • Not interfere with or disrupt the Service, its infrastructure, or other Customers
  • Not use the Service to attack, probe, or scan other systems

7. AI use

The Service uses AI to qualify End User enquiries. You acknowledge that:

  • AI responses are generated automatically and may contain errors
  • You are responsible for reviewing qualified leads before relying on them for material business decisions
  • You should not configure qualification flows that solicit, store, or process information that is unlawful to collect

8. Reporting violations

If you become aware of a violation of this AUP, please report it to [email protected].

9. Enforcement

We may investigate suspected violations of this AUP. Depending on the severity, we may:

  • Issue a warning
  • Suspend access to the Service
  • Terminate your account
  • Report violations to law enforcement or regulators where required by law

10. Changes to this AUP

We may update this AUP from time to time. The "Last updated" date at the top reflects the most recent change. Material changes will be notified by email at least 30 days before they take effect.
